These Terms of Service ("Terms") govern your use of Visual Fence Pro ("Service"), operated by Visual Fence Pro ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.
Visual Fence Pro is a web-based estimating and project management tool for fence contractors. The Service allows you to draw fence lines on satellite maps, calculate materials and labor, generate quotes, share quotes with customers, collect signatures, and manage work orders.
You must create an account to use the Service. You agree to:
New accounts receive a 14-day free trial with full access to your selected plan. You will not be charged during the trial period.
After your trial ends, you must subscribe to a paid plan to continue using the Service. Subscription fees are billed monthly or annually, depending on your selection. All fees are in US dollars.
You may cancel your subscription at any time from your account Settings. Upon cancellation, you retain access through the end of your current billing period. After that, your account becomes inactive but your data is retained for 90 days.
Subscription fees are non-refundable except where required by applicable law. If you cancel during your free trial, no charges apply.
You agree not to:
You own your data. All project data, customer information, quotes, work orders, and other content you create using the Service belongs to you. We do not claim ownership over your content.
You grant us a limited license to host, store, and process your data solely for the purpose of providing the Service to you. This license ends when you delete your data or close your account.
The Service may integrate with third-party services including Stripe (payments), Intuit QuickBooks (accounting), and Mapbox (mapping). Your use of these integrations is subject to the respective third party's terms of service. We are not responsible for the availability, accuracy, or policies of third-party services.
Connecting your QuickBooks account is optional and initiated by you. You may disconnect at any time. We access your QuickBooks data only to perform the sync operations you request.
The Service, including its design, code, features, and documentation, is owned by Visual Fence Pro and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for your business operations during your active subscription.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
Material calculations, cost estimates, and measurements provided by the Service are tools to assist your professional judgment. You are responsible for verifying all measurements and calculations before relying on them for customer quotes or material orders.
To the maximum extent permitted by law, Visual Fence Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.
Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify and hold harmless Visual Fence Pro, its officers, and employees from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
We may suspend or terminate your account if you violate these Terms or engage in activity that harms the Service or other users. We will attempt to notify you before termination when reasonably possible.
Upon termination, your right to use the Service ceases immediately. Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.
We may update these Terms from time to time. We will notify you of material changes by email or through a notice in the application at least 30 days before the changes take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.
